Effective Date: December 7, 2025
1. Overview
These Terms of Service (“Terms”) govern your access to and use of the websites, apps, online programs, and other services provided by Surf Strong Fit LLC (“Surf Strong Fit,” “we,” “us,” or “our”).
By accessing or using any of our websites, purchasing a program, creating an account, or participating in any of our online coaching or related services (collectively, the “Services”), you agree to be bound by these Terms. If you do not agree, do not use the Services.
2. Acceptance of Terms
By any of the following actions:
accessing or using our websites,
creating an account,
purchasing or enrolling in any program, membership, or digital product, or
clicking “I agree,” “Accept,” “Complete Purchase,” or a similar button where this option is made available,
you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
3. Governing Law
These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the State of California, without regard to its conflict of laws rules, except as preempted by federal law.
4. About Surf Strong Fit
Surf Strong Fit LLC is a limited liability company organized under the laws of the State of California, with its principal place of business in California, USA. The Services are operated from the United States. If you access the Services from outside the United States, you are responsible for complying with any local laws that apply.
5. Health & Medical Disclaimer (No Medical Advice)
(a) Surf Strong Fit provides educational information and fitness-coaching services focused on surf-specific movement, strength, mobility, and breath training. We are not a medical organization and do not provide medical diagnosis, treatment, or prescription of any kind.
(b) Nothing on our websites, in our emails or messages, or in any coaching sessions (live or recorded) should be considered medical advice. The content is not a substitute for professional medical care, diagnosis, or treatment.
(c) You should always consult a physician or other qualified health provider before beginning any new exercise, surf-training, nutrition, or breath-work program, especially if you have (or think you may have) a medical condition, injury, or other health concern.
(d) Who Our Services Are For. Our programs are designed for adults age 18 or older. Pregnant individuals and people with any medical condition, prior injury, surgery, or significant pain (including shoulder, spine, hip, or cardiovascular issues) should use the Services only after receiving clearance from their physician. If your doctor advises you not to participate in physical activity or the type of training we offer, you must follow that advice and not use the Services.
(e) Emergencies. If you believe you are experiencing a medical emergency, call 911 or your local emergency number immediately. Do not rely on the Services, our websites, or any messages from us for emergency care.
6. Eligibility; Minors
(a) The Services are intended for individuals age 18 and over. We do not knowingly enter into contracts with, or collect personal information from, children under 18 without the involvement of a parent or legal guardian.
(b) If you are a parent or legal guardian and you allow your minor child (for example, a teen surfer) to use the Services, you are responsible for their use and you agree to these Terms on their behalf. You also agree that the Health & Medical Disclaimer and Assumption of Risk sections apply to the minor to the fullest extent permitted by law.
(c) If we learn that we have collected personal information from someone under 18 without verifiable parental consent, we will delete it as soon as reasonably practicable.
7. Accounts and Security
(a) To access certain features of the Services, you may be required to create an account and provide accurate, current, and complete information. You agree to keep your account information up to date.
(b) You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us promptly of any unauthorized access or use of your account.
(c) You may not share your account or login credentials with any other person or permit others to access the Services through your account.
8. Fees, Payments, and Subscriptions
(a) Fees and Billing. Prices, fees, and payment terms for our programs, memberships, and digital products are described at the point of purchase. We may change our pricing from time to time; changes will not affect any purchase you have already made.
(b) Payment Methods. You authorize us (and our third-party payment processors) to charge the payment method you provide at checkout for all applicable fees and any applicable taxes. If payment cannot be completed, we may suspend or terminate your access to the Services.
(c) Recurring Subscriptions and Auto-Renewal.
If you enroll in a recurring membership or subscription (for example, an ongoing coaching or training plan), you authorize Surf Strong Fit to automatically charge the payment method you provide at the recurring interval disclosed at checkout (for example, monthly or quarterly) until you cancel. Before you complete enrollment in a recurring subscription, we will clearly disclose the renewal terms, billing frequency, and how to cancel.
(d) Confirmation and Renewal Notices.
After you enroll in a recurring subscription, we may send you an email or other communication confirming your enrollment and summarizing the key terms of the offer, including the renewal and cancellation policy and how you can cancel. For certain longer-term subscriptions, we may provide additional renewal notices to the extent required by applicable law.
(e) Cancellation of Recurring Subscriptions.
You may cancel a recurring subscription at any time by logging into your account and following the cancellation instructions, or by contacting us using the contact information below. Unless otherwise stated at the time of purchase or required by law, cancellation will take effect at the end of your current billing period, and you will continue to have access to the Services through that period.
(f) Refunds.
Unless we expressly state otherwise at the time of purchase or are required by law, all fees are non-refundable, including for partially used subscription periods. Any specific refund policies associated with a particular program or promotion will be stated at the point of purchase and will govern that purchase.
(g) Chargebacks.
If you dispute a charge directly with your payment provider (for example, by initiating a credit card chargeback) without first attempting in good faith to resolve the matter with us, we may suspend or terminate your access to the Services associated with that charge until the dispute is resolved.
9. Intellectual Property; License to Use
(a) All content and materials made available through the Services—including workouts, programs, videos, audio, images, text, graphics, logos, and software (collectively, “Content”)—are owned by Surf Strong Fit or our licensors and are protected by copyright, trademark, and other laws.
(b) Subject to these Terms and any program-specific terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Content for your personal, non-commercial use in connection with your own surf-fitness training.
(c) Except as expressly allowed in these Terms, you may not reproduce, distribute, publicly display, modify, create derivative works of, or exploit the Content for any commercial purpose without our prior written consent. All rights not expressly granted are reserved.
10. Third-Party Services & Content
(a) We may use or link to third-party platforms or services (such as training apps, payment processors, scheduling tools, or video platforms). Your use of any third-party service is subject to that provider’s own terms and privacy policies. We do not control and are not responsible for any third-party services or content, and we do not endorse them.
(b) Certain Content may be licensed to us by third parties and is provided for your personal use only. You may not resell, redistribute, or make this Content available to others except as expressly allowed in these Terms.
11. Our Right to Monitor and Remove Content
We may, but are not obligated to, monitor access to or use of the Services and Content. We may remove or disable access to any content at our discretion, including if we believe it is unlawful, infringing, abusive, or otherwise objectionable, or if it violates these Terms. Nothing in this section obligates us to monitor the Services or to take any particular action with respect to specific content.
12. Client Responsibilities and Acceptable Use
(a) You agree to:
provide accurate and complete information about your health history and physical condition when requested;
follow all instructions, safety guidelines, and modifications provided for exercises and surf-related training;
use good judgment and stop or modify exercises if you experience pain, dizziness, or discomfort; and
promptly seek medical advice if you experience concerning symptoms related to your participation in any program.
(b) You may not:
use the Services for any unlawful purpose or in violation of any applicable law;
attempt to gain unauthorized access to any part of the Services or to other users’ accounts;
copy, distribute, or disclose any part of the Services or Content in any medium, including by automated or non-automated “scraping”;
use the Services or Content to create a competing product or service; or
interfere with, or attempt to interfere with, the proper functioning of the Services.
13. Changes to the Services and These Terms
(a) We may modify or discontinue any part of the Services at any time.
(b) We may update these Terms from time to time. When we do, we will update the “Effective Date” at the top. If we make material changes that affect your rights or obligations, we will provide additional notice, such as by email or by posting a prominent notice in your account or on our website.
(c) If you continue to use the Services after the updated Terms become effective, you agree to the new Terms. For users on recurring subscription plans, we will comply with any additional notice or consent requirements under applicable law.
(d) We may suspend or terminate your access to the Services at any time, including if we believe you have violated these Terms or are using the Services in a way that creates risk or harm.
14. No Guarantee of Results
Everyone’s body, health history, and surfing background are different. We cannot and do not guarantee any specific performance, health, or surf-related results from your use of the Services. Your results will depend on many individual factors, including your effort, consistency, health status, and adherence to the programs.
15. Limitation of Liability
To the fullest extent permitted by law, Surf Strong Fit and its owners, officers, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, whether incurred directly or indirectly, arising out of or in connection with your use of the Services or these Terms.
To the fullest extent permitted by law, our total liability for any claim arising out of or relating to the Services or these Terms will be limited to the greater of: (a) the amounts you paid to us for the Services giving rise to the claim during the three (3) months before the event giving rise to the claim, or (b) one hundred dollars (US $100).
Nothing in these Terms is intended to limit or exclude liability that cannot be limited or excluded under applicable law (including liability for willful misconduct or where such limitations are prohibited under California Civil Code section 1668).
16. Warranty Disclaimer
The Services and all Content are provided “as is” and “as available.” To the fullest extent permitted by law, Surf Strong Fit disclaims all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We do not warrant that the Services will be uninterrupted, secure, or error-free, or that any particular results will be achieved. Your use of the Services is at your own risk, subject to the Health & Medical Disclaimer above.
17. Assumption of Risk
You understand that physical activity, exercise, surf training, and breath-work involve inherent risks, including but not limited to muscle strains, joint injuries, falls, collisions, drowning, and, in rare cases, serious injury or death. By choosing to participate in any program, session, or activity offered by Surf Strong Fit, you voluntarily assume all risks associated with such participation to the fullest extent permitted by law.
You are solely responsible for listening to your body, modifying or stopping exercises as needed, and seeking medical advice where appropriate.
18. Indemnification
You agree to indemnify, defend, and hold harmless Surf Strong Fit and its owners, officers, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your violation of these Terms; or (c) your violation of any rights of a third party.
19. Dispute Resolution; Arbitration
(a) Good-Faith Resolution. If you have a dispute with us, please contact us first so we can try to resolve it informally.
(b) Agreement to Arbitrate. Except as provided below, you and Surf Strong Fit agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration will take place in California, unless we both agree to another location or to a remote proceeding.
(c) Exceptions. Either party may (i) bring an individual claim in small-claims court, or (ii) seek temporary or preliminary injunctive relief in a court of competent jurisdiction to protect confidential information or intellectual property.
(d) No Class Actions. To the fullest extent permitted by law, disputes must be brought on an individual basis and not as a plaintiff or class member in any purported class or representative proceeding.
(e) Public Injunctive Relief. Nothing in this section is intended to waive your right, where applicable, to seek public injunctive relief under California law in a court of competent jurisdiction.
20. Miscellaneous
(a) Entire Agreement. These Terms, together with our Privacy Policy and any program-specific terms that you agree to at purchase, constitute the entire agreement between you and Surf Strong Fit regarding the Services and supersede any prior or contemporaneous understandings or agreements (whether oral or written).
(b) Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect.
(c) No Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
(d) Assignment. You may not assign, transfer, or delegate these Terms or your rights and obligations under them without our prior written consent. We may assign or transfer our rights and obligations under these Terms without your consent.
(e) Relationship of the Parties. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Surf Strong Fit.
